What's Next After Filing

Once your LLC is officially formed, you'll want to complete these important steps:

  • Create an Operating AgreementAlthough not legally required by Indiana law, drafting an Operating Agreement is strongly recommended to outline ownership structure, member roles, profit distribution, and management procedures. This internal document helps prevent disputes and establishes credibility.
  • Obtain an EIN from the IRSApply for a Federal Employer Identification Number (EIN) from the IRS online at no cost, even if the LLC has no employees. An EIN is required to open a business bank account, hire employees, and file federal and state taxes.
  • File Biennial Business Entity ReportIndiana LLCs are required to file a Business Entity Report every two years with the Secretary of State via INBiz, due by the last day of the anniversary month of formation. The filing fee is $32 online or $50 by paper.
